The provisions on switching between data processing services only apply if the provider from which and the provider to which a customer is switching cover the “same service type” (Article 23 of the Data Act). According to the definition in Article 2 (9) of the Data Act, this means that the data processing services must share the same “primary objective”, the same “main functionalities” and the same data processing service model.
