Grand Rul­ing Cham­ber for En­er­gy

The amended Energy Industry Act (EnWG), which came into force at the end of 2023/beginning of 2024, sets out the establishment of a "Grand Ruling Chamber for Energy" at the Bundesnetzagentur according to Section 59(3) EnWG.

The legal provisions restrict the area of responsibility to the rules under sections 20 to 23a, sections 24 to 24b and section 28o(3) EnWG.

The Grand Ruling Chamber for Energy issues nationally applicable determinations on the conditions and methods for network access and for determining the tariffs for network access, including cost and incentive regulation.

A coordination office will assist the Grand Ruling Chamber for Energy in its procedures.

Structure of determinations

The Bundesnetzagentur proposes having two levels of determinations for costs and revenues and incentive regulation under the Grand Ruling Chamber's responsibility.

The first level would be "framework determinations", which would determine the key characteristics of the regulatory systems for the different network operator groups, while the second level would be "methodology determinations", which would specify the details of the individual elements of each regulatory system.

Determinations relating to individual undertakings or periods that are currently issued by the established ruling chambers (third level) will remain the responsibility of these ruling chambers.
