Methodology determination for the general sectoral productivity factor
Consultation on a key elements paper and opening of proceedings for the determination of a methodology for the future design of the general sectoral productivity factor for electricity distribution system operators and gas distribution and transmission system operators [GBK-24-02-3#4]
The Grand Ruling Chamber for Energy opened proceedings for the determination of a methodology for the future determination of the general sectoral productivity factor for electricity distribution system operators and gas distribution and transmission system operators in accordance with section 29(1) in conjunction with sections 21 and 21a of the Energy Industry Act (EnWG). The proceedings were opened on 28 August 2024 [GBK-24-02-3#4].
The responsibility of the Grand Ruling Chamber derives from section 59(3) sentence 3 in conjunction with section 54(3), section 21 and section 21a of the Energy Industry Act (EnWG).
Key elements paper
The key elements presented by the Grand Ruling Chamber build on and supplement the considerations set out in the N.E.S.T. key elements paper with respect to the future design of the general sectoral productivity factor.
The key elements paper is to be seen as the current status of the Grand Ruling Chamber's plans following the discussion of the N.E.S.T. key elements paper and as an initial step in the determination proceedings. It reflects the Grand Ruling Chamber's current views, among other things in order to structure the future scope of the proceedings. It also outlines the Grand Ruling Chamber's thoughts about the future design of the general sectoral productivity factor. The key elements paper presents the Bundesnetzagentur's current preferred design, while explaining why alternative methods are not considered appropriate.
The Grand Ruling Chamber drew up the key elements paper with the responses to the N.E.S.T. key elements paper in mind. An expert dialogue on this topic is being held on 2 September 2024 to accompany the publication of the key elements paper. Details can be found here.
Comments on the key elements paper can be submitted until
14 October 2024 (date of receipt) (previously 30 September 2024).
Responses must be in German, marked "Zukünftiger Produktivitätsfaktor GBK-24-02-3#4" and emailed to gbk@bnetza.de.

Respondents must fill in their contact details on the first sheet before they can enter their comments on the second sheet. The form can be used to specify the section of the key elements paper each comment refers to.
The Bundesnetzagentur plans to publish on its website the comments provided on the second sheet (excluding any trade and business secrets or personal data). Respondents should therefore provide an additional version of their response that is suitable for publication.

The Grand Ruling Chamber will draw up a draft determination on the basis of the comments received and the expert dialogue in the first quarter of 2025, which it will then also put out for consultation.
Note relating to transparency: on 15 July 2024 Netze BW gave a presentation explaining its proposal for the future design of the productivity factor to the Bundesnetzagentur, the BDEW (German Association of Energy and Water Industries), the VKU (Verband kommunaler Unternehmen e.V.) and other sector representatives.
