Determination on the phaseout of tariffs for distributed generation from 2026 to 2028

Initiation of proceedings
On 10 April 2025 the Grand Ruling Chamber for Energy opened proceedings for the phaseout of tariffs for distributed feed-in pursuant to section 18 of the Electricity Network Tariffs Ordinance (StromNEV) from 2026 to 2028 pursuant to section 29(1) in conjunction with sections 21 and 21a of the Energy Industry Act (EnWG).
The tariff for distributed feed-in pursuant to section 18 StromNEV is a payment to generating installations connected to distribution systems. When they feed in electrical energy, in addition to the market revenue they receive a tariff based on the sums that would be paid by the network operator to whose network the installation is connected for the consumption from the upstream network level that would otherwise be necessary. Network users bear these costs via their network tariffs. They currently amount to about €1bn a year.
The Bundesnetzagentur plans to phase out the tariffs for distributed generation in four stages starting in 2026, so that they reach zero by 31 December 2028. Network users will save a total of approximately €1.5bn between 2026 and 2028.
The responsibility of the Grand Ruling Chamber derives from section 59(3) sentence 3 in conjunction with section 54(3), section 21 and section 21a EnWG.
The consultation on the draft determination (in German only) will take place alongside the publication of the proceedings.
