Methodology determination for quality regulation
Opening of proceedings for the methodology determination for quality regulation and consultation on the key elements for the methods for incentive mechanisms for quality of supply in energy supply networks [GBK-24-02-1#4]
The Grand Ruling Chamber for Energy opened proceedings for the determination of the future design of the methods for quality regulation for the operators of electricity and gas distribution systems in accordance with section 29(1) EnWG in conjunction with sections 21 and 21a(3) sentence 2 para 5 EnWG. The proceedings were opened on 14 October 2024 [GBK-24-02-1#4].
Under sections 21 and 21a(3) sentence 2 para 5 EnWG, the Bundesnetzagentur can lay down rules for the determination and detailed design of quality requirements that are based on, for example, an assessment of network reliability or network performance indicators and take account of objective, structural differences between individual network operators.
In line with international regulatory practice, network service quality and product quality are regarded as factors of quality of supply in energy supply networks in addition to network reliability and network performance. Against this background, the Bundesnetzagentur is working on extending quality regulation to include energy transition competence and possibly network service quality in addition to network reliability and network performance.
The responsibility of the Grand Ruling Chamber derives from section 59(3) sentence 2 in conjunction with section 54(3), section 21 and section 21a EnWG.
Key elements paper
The key elements presented by the Grand Ruling Chamber build on and supplement the considerations set out in the N.E.S.T. key elements paper with respect to the future design of quality regulation. The key elements take account of the comments received during the N.E.S.T. process.
The key elements paper on the gradual development of quality regulation for electricity and gas distribution system operators is to be seen as the Grand Ruling Chamber's interim conclusions following the discussion of the N.E.S.T. key elements paper and as an initial step in the determination proceedings. The key elements paper reflects the Grand Ruling Chamber's current views and serves as a basis for discussions with industry, civil society and representatives from politics and academia. The paper also serves to structure the future scope of the proceedings. The focus of the paper is solely on the area of quality regulation.
Comments on the key elements paper can be submitted until 29 November 2024 (date of receipt).

The Bundesnetzagentur plans to publish on its website the comments provided on the second sheet (excluding any trade and business secrets or personal data). Respondents should therefore provide an additional version of their response that is suitable for publication.
