Framework determinations (Level 1)

The framework determinations lay down the basic aspects of the regulatory system.

As regards regulating the costs of electricity and gas distribution system operators and gas transmission system operators, for example, a determination at this level would define the elements of the cost regulation system. Questions addressed at this level may include:

  • How long is a regulatory period?
  • Is there individual efficiency benchmarking – for electricity and gas?
  • Is there a general sectoral productivity factor and what does it apply to?
  • Is there an adjustment rule for certain types of costs (permanently non-controllable costs, capital costs)?
  • Are there still special rules for small network operators, similar to the simplified procedure, and if so, which rules?
