Determining efficiency requirements under section 16(2) ARegV

Pursuant to section 16(2) of the Incentive Regulation Ordinance (ARegV), the individual efficiency requirement may be determined in derogation of section 16(1) ARegV if the network operator proves that it cannot meet and surpass the individual efficiency requirement using all possible and reasonable measures at its disposal.
Section 16(2) ARegV ensures that it is possible to examine in individual cases whether the measures to be taken by the network operator are reasonable.
The application must be submitted to the Bundesnetzagentur in writing.
