Recognition of notified bodies under the R&TTE Act
What are the tasks of notified bodies under the Radio Equipment and Telecommunications Terminal Equipment Act?
The equipment covered by the German Radio Equipment and Telecommunications Terminal Equipment Act (R&TTE Act) constitutes radio equipment, telecommunications terminal equipment or a combination of both. The following essential requirements apply to all the equipment:
- protection of health and safety of users and other persons, including the requirements laid down in section 2 of the Ordinance concerning the placing on the market of electrical equipment designed for use within certain voltage limits of 11 June 1979 (Federal Law Gazette I page 629), as amended by Article 1 of the Ordinance of 28 September 1995 (Federal Law Gazette I page 1213), but without application of the voltage limits;
- the protection requirements laid down in section 4 of the German Electromagnetic Compatibility of Equipment Act (EMC Act) of 26 February 2008 (Federal Law Gazette I page 220) relating to electromagnetic compatibility (see section 22(1) para 1 of the EMC Act).
In addition, radio equipment must be constructed such that it effectively uses the spectrum allocated to terrestrial/space radio communication and orbital resources so as to avoid harmful interference (section 3(1) and (2) of the R&TTE Act).
A notified body is authorised to carry out the tasks of conformity assessment and of assessment and monitoring of quality systems as decribed in at least one of Annexes III, IV and V to Directive 1999/5/EC.
What is the procedure for becoming a notified body under the R&TTE Act?
The Bundesnetzagentur recognises natural/legal persons or partnerships with legal capacity who or which have the competence and staff required to carry out the tasks under the R&TTE Act as notified bodies, upon application.
Such recognition confirms that the notified body has demonstrated in the course of a thorough assessment that it meets the criteria laid down in Annex VI to Directive 1999/5/EC and is capable of carrying out the tasks referred to in section 8(1) of the R&TTE Act in line with generally accepted technical standards.
Fees are payble for the recognition procedure in accordance with the Recognition Ordinance (AnerkV).
Recognised national notified bodies
Notification of the German notified bodies under the R&TTE Act was published in Communication No 135 in Official Gazette No 7/2013.
The bodies listed below have been recognised by the Bundesentzagentur as "notified bodies" in accordance with section 8(1) of the Radio Equipment and Telecommunications Terminal Equipment Act (FTEG) of 31 January 2001 (Federal Law Gazette I page 170), as last amended by Article 2 of the Act of 20 April 2012 (Federal Law Gazette I page 606) in conjunction with section 3(1) of the Ordinance concerning the requirements and procedure for the recognition of conformity assessment bodies (Recognition Ordinance – AnerkV) of 7 June 2002 (Federal Law Gazette I page 1792), as last amended by section 22(4) of the EMC Act of 26 February 2008 (Federal Law Gazette I page 220), in the field of radio equipment and telecommunications terminal equipment within the scope of Directive 1999/5/EC of the European Parliament and of the Council of 9 March 1999 on radio equipment and telecommunications terminal equipment and the mutual recognition of their conformity.
