Experimental Radio
General information
Under section 91(1) of the German Telecommunications Act (TKG) anyone wanting to use spectrum first needs an assignment from the Bundesnetzagentur. This also applies to anyone wanting to use spectrum to develop and trial radio equipment, use radio equipment for specific research purposes or trial new radio concepts.
In certain cases, in particular when spectrum is wanted to trial innovative telecommunications technologies or when spectrum is needed at short notice, and when justified, it is possible in accordance with section 97(2) TKG to grant assignments for the use of spectrum other than that listed in the Spectrum Ordinance or the Spectrum Plan for a limited period of time, provided that the use does not cause any degradation to any listed spectrum use.

Fees
Fees are charged for assigning spectrum and, under certain conditions, for rejecting applications. The fees are calculated in accordance with the applicable version of the Bundesnetzagentur's special ordinance on fees for spectrum assignment (BNetzA BGebV FreqZut).
The Ordinance is available at Besondere Gebührenverordnung der Bundesnetzagentur für Elektrizität, Gas, Telekommunikation, Post und Eisenbahnen für Frequenzzuteilungen (Besondere Gebührenverordnung Bundesnetzagentur - Frequenzzuteilungen (gesetze-im-internet.de) (in German).
Spectrum assignment holders must also pay annual contributions. These contributions are calculated in accordance with the applicable version of the Spectrum Protection Contributions Ordinance (FSBeitrV).
