Step 1
Non-binding preliminary review

Please note that all operators of service facilities can send their proposed charges and charging principles to the Bundesnetzagentur for a non-binding preliminary review before the formal review procedure.

The objective of a preliminary review is the adjustment of the intended change in charges (and if necessary of the charging principles) to eliminate potential inconsistencies before the charges are submitted to the ruling chamber for the formal review procedure. If you want to take advantage of this opportunity, please send your intended revisions or changes to network statements for service facilities including which charging principles you plan to use and the amounts you intend to charge plus the main reasons for the revisions and changes for a preliminary review to 705-Postfach@BNetzA.de.

Step 2
Notification of intended revision or modification

To ensure that notified changes and amended versions of network statements for service facilities can enter into force in good time, notifications must be submitted to the Bundesnetzagentur by email to bk-eisenbahn@bnetza.de at least six weeks before their planned entry into force.

In the event that the notification cannot be submitted electronically or through DE-Mail (eg you receive an autoreply from the server that the email could not be delivered), it can, as an exception, be sent by fax to 0228-141010. An individual email may not exceed the size of 10 megabytes (MB). When an attempt to send significantly larger amounts of data by email (possibly in several parts) would be considerably more difficult (individual documents are larger than 10MB or a bundle of documents exceeds 50MB) the Ruling Chamber can, as an exception, create a closed user group (CUG). To request the creation of a CUG under these conditions please contact bk-eisenbahn@bnetza.de without delay.

Documents that are submitted may not contain any macros and must be in PDF or Excel file format.

Binding requirements for the nature and scope of a notification pursuant to section 72 sentence 1 para 5 ERegG were set by Ruling Chamber 10 on 29 April 2021 under file number BK10-21-0025_Z as part of a general administrative order addressed to all infrastructure managers in Germany. In the order it states on page 94 et seq:

To simplify the data collection as proof that the proposed charges comply with the requirements of the ERegG the Bundesnetzagentur offers a standardised data form EHB Unterrichtung § 72 ERegG (xlsx / 83 KB).

Step 4
Optional request for a public hearing

On application from a party or ex officio, Ruling Chamber 10 can conduct a public hearing pursuant to section 77(6) sentence 3 ERegG. A public hearing is not a standard element of a notification procedure.

Step 5
Examination by the Bundesnetzagentur for compliance with charging standards

The Bundesnetzagentur examines whether the charges and charging principles submitted comply with rail regulation requirements, in particular whether the charging standard in force at the time was complied with.
