Notification is a formal procedure under the EU’s new legislative framework. Product conformity can be assessed by a notified body, and in some cases conformity assessment is obligatory. In order to be able to operate as a notified body, a body has to be verified and recognised as such.

Notifying authorities “notify” (confirm) that a notified body may perform conformity assessment in accordance with an act of EU harmonisation legislation and meets the requirements set out in that legislative act.

Notification in the context of the AI Act means the official communication to the European Commission and the other EU Member States that a conformity assessment body has been verified and designated, as only these notified bodies may perform conformity assessment under the AI Act. In accordance with Article 6 of the AI Act, such notified bodies must be involved if an AI system is considered to be high-risk in order to assess whether the high-risk AI system is in conformity with the requirements of the AI Act.

Notifying authority

Article 70 of the AI Act requires at least one notifying authority to be established and designated as a national competent authority.

Any notification structures already in place in fields covered by harmonisation legislation (Annex I to the AI Act – for example medical devices, machinery and radio equipment) will be used, unless decided otherwise by the new federal government or by the legislature in legislation implementing the AI Act. These structures will also take on the tasks under the AI Act vis-à-vis the market players.

The Bundesnetzagentur is the competent notifying authority for the Directive relating to the making available on the market of radio equipment (2014/53/EU) listed in Annex I point 6 of the AI Act and will therefore carry out the associated activities and tasks under the AI Act as well.

Since 2 August 2025, the regulations regarding the activities and tasks of the notification of conformity assessment bodies for high-risk AI systems according to Annexes I and III No. 1 of the AI Regulation apply.
